BEMO Terms of Use
Contact: support@bemo.com.au
1. About these terms
BEMO is business administration software operated by Amanda Robinson T/A Barker IT (we, us or our). These terms apply to the organisation or sole trader that opens an account (you), and its authorised users. If you accept these terms for an organisation, you must have authority to do so.
These terms, the plan details accepted at purchase and our Privacy Notice explain the service and the parties' responsibilities. A privacy notice is not, by itself, consent to collect or disclose sensitive information. Your separate agreements with participants, workers and other customers remain your responsibility.
2. What BEMO provides
BEMO provides tools for managing participants, supports, scheduling, business records, invoices, receipts, reports and service agreements. Features and usage limits depend on your selected plan and the functions made available to you.
BEMO is not an emergency service, a care provider, a financial adviser, a legal adviser or a guarantee of NDIS compliance. For an emergency, call 000. You remain responsible for care decisions, safeguarding, worker qualifications, service delivery, pricing, claims, tax treatment and regulatory obligations. Check generated documents and calculations before relying on them. Catalogue information and templates may need updating or adjustment to your circumstances.
3. Accounts and security
Provide accurate account information and keep it current. Only give access to people authorised to act for your business, assign appropriate permissions, and promptly remove access when it is no longer needed. Do not share individual login credentials. Use strong passwords and any required multi-factor authentication.
Notify support@bemo.com.au promptly if you suspect unauthorised access, lost credentials or disclosure of information. We may require identity checks before restoring access. Private administrator access does not replace account authentication or MFA.
You are responsible for your authorised users' use of BEMO. This does not make you responsible for failures caused by our own acts or omissions.
4. Participant and business information
You retain your rights in the information and documents you upload or create. You authorise us and the service providers we engage to handle that information as necessary to provide, secure, support and maintain BEMO, subject to our Privacy Notice and applicable law.
Only upload information you are authorised to handle. Give individuals any required collection notices and obtain appropriate consent or other lawful authority, particularly for health, disability and other sensitive information. Obtain authority from the individual or a legally authorised representative where required; do not assume that a family member, carer or contact automatically has that authority.
Keep records accurate and review permissions before sharing, exporting or emailing information. Do not upload unnecessary identity documents, payment-card details or information unrelated to your legitimate business activities. Keep copies needed to meet your own recordkeeping obligations.
5. Acceptable use
Do not use BEMO unlawfully, submit false claims or misleading records, infringe another person's rights, upload malware, bypass access controls, probe another account, or interfere with the service. Do not use automated access that materially disrupts BEMO without our agreement. Report suspected vulnerabilities privately to support@bemo.com.au and avoid accessing other people's information.
6. Plans, charges and cancellation
The price, GST treatment, billing interval, included features, limits and any renewal arrangement must be disclosed before you purchase. We will not treat these terms alone as authorisation for an undisclosed recurring charge.
If you agree to a recurring plan, charges continue at the disclosed interval until cancellation takes effect. You may request cancellation through an available account control or by emailing support@bemo.com.au. Unless the accepted plan specifies a different lawful arrangement, cancellation stops the next renewal and access continues until the end of the paid period.
Refunds and other remedies required by law remain available. Contact us about disputed charges or service problems. There is no blanket exclusion of refunds under these terms.
We will give at least 30 days' notice of a price increase or material reduction in a paid plan. The change will not take effect before the next renewal after that notice period, and you may cancel before it takes effect without a cancellation penalty. Changes you expressly request may take effect earlier.
7. Availability, maintenance and integrations
We will use reasonable care and skill to operate BEMO and take reasonable steps to protect its information. Maintenance, internet failures and third-party outages may interrupt service. We will give reasonable notice of planned material interruptions where practicable. These terms do not promise uninterrupted availability or a particular recovery time.
Optional payment, calendar and other integrations may have separate provider terms and privacy practices. Review them before connecting an account. We remain responsible for our own handling of information and our legal obligations when using service providers. A successful export, email or integration request is not proof that a recipient has received, accepted or acted on it.
8. Suspension and ending access
We may restrict access where reasonably necessary to address a security threat, unlawful activity, material breach or overdue payment. Restrictions should be proportionate. Where practicable, we will explain the reason and provide an opportunity to resolve the issue before suspending access. Urgent security or legal restrictions may take effect immediately.
If we discontinue BEMO for reasons unrelated to your breach, we will give reasonable advance notice, provide a reasonable opportunity to export your records where lawful and practicable, and refund prepaid charges for the unused service period.
You may request cancellation and export assistance at support@bemo.com.au. Ending an account does not automatically erase all records. Retention, deletion requests, legal holds and backups are addressed in our Privacy Notice. Do not rely on continued account access to satisfy your recordkeeping duties.
9. Intellectual property
We or our licensors own BEMO's software, branding and other service materials. During your authorised access, you may use them for your business within your plan. These terms do not transfer ownership of your uploaded records to us or prevent you from exporting your own information. Third-party components remain subject to their applicable licences.
10. Consumer rights and responsibility
Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where applicable, services must be provided with due care and skill, be fit for a disclosed purpose, and be supplied within a reasonable time.
Each party remains responsible for its own breach, negligence and other conduct to the extent provided by law. These terms do not impose an unlimited indemnity on you, exclude our responsibility for all data loss, or cap statutory remedies.
11. Changes and complaints
We may update these terms to reflect service or legal changes. We will give reasonable advance notice of material changes and explain when they take effect. Changes will not retrospectively remove accrued rights. If a change materially disadvantages you, you may cancel before it takes effect without a cancellation penalty; any prepaid amount for service we will no longer provide on the agreed basis will be addressed fairly and consistently with law. Urgent changes needed for security or law may take effect sooner, with notice as soon as practicable.
Contact support@bemo.com.au with complaints, giving enough detail to investigate without unnecessarily emailing sensitive records. We will acknowledge the complaint, investigate and aim to respond within 30 days. You retain any right to approach a regulator, tribunal or court. Australian law applies, and any applicable state or territory law and mandatory jurisdiction rights are preserved.
