RIDER TERMS AND CONDITIIONS

AGREEMENT

(a)When choosing BEMO as your preferred platform for rideshare services. We would like to draw your attention to our Terms of Use, which govern your use of services and any other services made available through our platform. We request that you carefully review these terms before using our services to ensure a safe and enjoyable experience for all users.

(b)By using the Platform, you agree to be bound by these Terms which form a binding contractual agreement between you, the user of the Platform (you or User) and us, Bemo pty ltd ACN 679 795 218.

(c)If you do not agree to these terms, please do not use the Platform.

​(d)By using our platform, you agree to our terms and conditions. Please be aware that we reserve the right to modify these terms at any time by updating webpage. Your continued use of the platform following such update will represent an agreement by you to be bound by the terms as amended. We recommend that you review these terms periodically to stay informed about any changes

ACCOUNTS

1.Account registration 

  (a)To fully utilize the functionality of our platform, it is mandatory for all users to register and create an account

  (b)To register and use our platform, we need your personal information. We handle it carefully and in accordance with our privacy policy.

  (c)We would like to inform you that by completing the Account registration process, you are agreeing to provide BEMO with accurate, honest,                  correct, and up-to-date information. It is your to ensure that all information provided during the registration process is true and complete to the            best of your knowledge. Please note that BEMO reserves the right to terminate your account if any information provided is found to be false or              misleading.

  (d)By completing the Account registration process, you agree to the following terms and conditions:

       (1). BEMO reserves the right to accept or reject your registration as a user of the Platform at its absolute discretion.

       (2). You are solely responsible for maintaining the confidentiality of your Account login details for all activities that occur under your Account.

       (3). You agree to accurate and complete information during the registration process and to update your Account information as necessary.

       (4). You agree to use the Platform only for lawful purposes and in accordance with these terms and conditions.

       (5). BEMO reserves the right to terminate your Account and access to the Platform at any time, without notice, for any reason, including if you                     violate these terms and conditions. 

  (e)At BEMO, we prioritize the safety and security of our users. As such, we the right to contact you in the event of any concerning behavior on your          part. Additionally, we may reach out to you to seek resolution in the case of any disputes or issues. By utilizing our platform, you agree to                        cooperate with us in such situations and provide us with accurate information to facilitate the resolution of any concerns.

2. Account rules

   (a)​Unauthorized use of Bemo Platform is prohibited. Users must not copy, reproduce, translate, adapt, vary or modify the Platform without our                  consent. We take intellectual property seriously and expect Users to do the same

   (b)Maintain login confidentiality, don't share with others. You're responsible for account activity. We may terminate if we suspect misuse. Notify us            of unauthorized access

   (c)We would like to remind that it is strictly prohibited to impersonate any other user of the platform, whether it be through explicit or implicit               means. Furthermore, we kindly request that you refrain from using the profile, password, or account of another user at any. Please be advised that           any violation of this policy may result in account suspension or termination. 

   (d)The platform is intended solely for the purpose of making arrangements to provide or receive services. Any other use  of the platform is                           strictly prohibited. We reserve the right to terminate your account if we suspect any of the platform

   (e)our platform is committed to ensuring the safety and security of all users, including drivers. As such, we have a strict policy against any form of             harassment, impersonation, stalking, threatening, bullying, or endangerment of any other user. We expect all users to conduct themselves in a                 professional and respectful manner towards one. Any violation of this policy will result in immediate, including account suspension or termination

   (f)By using our platform, you agree not to engage in any illegal or fraudulent activities, or to facilitate such activities. This includes requesting or               accepting jobs that involve illegal activities or purposes. We reserve the right to appropriate action, including account suspension or termination,           if we suspect any violation of this policy. 

   (g) By using our platform, you agree not to engage in any behavior that may harm the reputation of BEMO or any associated or interested parties.               Additionally, you agree not to take any actions that are contrary to the interests of BEMO or the platform. We take these matters seriously and               reserve the right to take appropriate action if we believe that any user is violating terms

   (h)By using our services, you agree not to use the platform for any commercial, promotional, or marketing purposes unless it is explicitly by us or               approved in writing. We reserve the right to take appropriate if we find any violation of this policy

   (i)By receiving or making any payments via our Platform, you acknowledge and agree to abide by the terms and conditions of PayPal or any other              payment method that you choose use. It is your responsibility to read and understand the terms of use of these payment methods, which can be              found on their respective websites. We are not responsible for any issues or disputes that may arise from your use of these payment methods

RIDER TERM

(a) when choosing our services through plaform by specifying your pick up and drop off locations, you agree to provide accurate information. Which will be distributed to the closest Driver

(b)We take pride in providing a secure and respectful environment for all our users. As a user of our platform, we kindly request that you conduct yourself in a professional and courteous manner towards the Driver. Any form of harassment, discrimination, or abusive behavior towards the Driver will not be tolerated and may result in suspension or termination of your account. We would like to emphasize that we have a zero-tolerance policy towards any form of harassment, whether it be verbal or non-verbal, including but not limited to touching, hugging, kissing, and making inappropriate jokes. By using our, you agree to treat all users with respect and refrain from engaging in any behavior that could be considered harassment. Any violation of this policy will result in immediate termination of your account and may also result in legal action.

(c)any damage caused by rider to the vehicle during the trip, including incidents of vomiting, damage intentionally or un-intentionally, rider responsible and will require to pay for the reasonable costs of cleaning, repair, or replacement. We kindly request that you take utmost care of the third party/ driver vehicle to avoid any additional expenses

(d)As Our top priority is the safety of our passengers and drivers. Therefore, we reserve the right to refuse service to any passenger who exhibits unsafe behavior or appears to be under the influence of drugs or alcohol.

(e)When requesting any additional stops outside of the platform. Please note that our drivers reserve the right to refuse any additional stops that were not previously arranged through the platform. This policy is in place to ensure the safety and efficiency of our services

(f)If you encounter any issues with a driver, you have the right to file a complaint. However, please note that we take false complaints very seriously and they may result in the termination of your account. To ensure fairness accuracy, we require that all complaints be accompanied by valid proof of misconduct. Our team will investigate all complaints thoroughly to ensure the safety and satisfaction of our riders. Please be advised that Bemo shall not be held liable for any loss or cost incurred as a result of a complaint. In the event of a serious complaint, we strongly recommend that riders inform the law enforcement. 

(g)To request that any lost items must be reported to us promptly. Please be advised that we cannot be held liable for any lost items in a third-party vehicle. Our role is to act as an intermediary on behalf of the driver, enabling you to communicate with them directly.

(h)As a condition of using our platform, we require that all payments be processed through our system. It is strictly prohibited to offer or accept cash payments outside of our platform. Please note that we cannot assume any responsibility for transactions or interactions that occur outside of our platform, and we cannot be held liable for any resulting damages or losses by third party. 

(i)To ensure a safe healthy environment for everyone, we have a strict policy against smoking, vaping, and drug use in our vehicles. In the event that the driver observes any of these activities, the driver reserve the right to refuse or cancel the trip.

(j)Please be advised that if you cancel your trip or reservation within a short period of time you may be subject to cancellation fees. It's important to note that these fees may apply unless the driver cancels the trip. In the event a cancellation of a reservation made through our platform, booking fees will still apply. This is to cover the costs incurred by our company in processing the reservation. Bemo shall not be held liable for any losses arising from the cancellation of trips or reservations made by riders who have breached our terms and conditions. It is the responsibility of the rider to ensure compliance with our policies and guidelines

(k)In order to prioritize the safety and security of all our users, we kindly request that all users be over the age of 18. Our drivers are instructed to ask for proof of identification upon pickup, unless accompanied by an adult. To ensure compliance with state laws, we require that children under age of 8 be secured in a child seat or booster. As a passenger, it is your responsibility to communicate this requirement to your driver and inquire about the availability of a child seat or booster.

CYBER SECURITY

We would like to inform you that we cannot accept responsibility for any loss or damage your computer systems, mobile phones, or other electronic devices that may occur as a result of your use of our platform. We highly recommend that you take necessary to ensure that your access to our platform is secure and does not expose you to any risks, such as viruses, malicious computer code, or other forms of interference

RECORDS AND AUDIT

 BEMO reserves the right to retain all records of transactions and communications made through this Platform between you and other Users, including conversations, user posts, job request bids, comments, feedback, cookies, and I.P. address information. These records will be used for administration purposes and may be produced in the event of any legal dispute involving BEMO. By using this Platform, you agree to the collection and retention of these records by BEMO
